While designed to protect your privacy, HIPAA regulations are so extensive that many providers are still confused about how to enforce them. This can sometimes make it difficult to obtain your records, even if you are fully entitled to them.

According to HIPAA, you have the right to request medical records in these circumstances:

  • You are the patient or the parent or guardian of the patient whose records are being requested.
  • You are a caregiver or advocate who has obtained written permission from the patient. In some cases, the healthcare provider will provide you a permission form that the patient must complete.

Many people assume that only they or their designees can obtain copies of their medical records. Under the law, there are other individuals or organizations who may also have the right.

This not only includes your primary care healthcare provider but third-party covered entities to whom you may have knowingly or unknowingly granted the right when signing a patient intake or registration form. These not only include medical practitioners, but organizations like insurance companies, hospitals, labs, nursing homes, rehabilitation centers, and billing providers.

Today, some people are even requesting their medical information be shared with mobile apps . Under HIPAA, you have the right to request this with the understanding that the healthcare provider who releases the information is not responsible for how the mobile app provider uses or secures your information.

Request Recent Military Records

If You Are Not the Veteran or Next-of-Kin

You can only get limited information about non-archival records without the consent of the veteran or next-of-kin. Non-archival records are those from 62 years ago to the present. Learn about access to non-archival military records by the general public and researchers.

Request Archived Health Records

If you need a copy of your health records, your local military hospital or clinic can provide one. You can only get copies of records related to a hospitalization, fetal tracings, or ambulance services from the facility where you got this care. Be prepared to give your full name, Sponsors Social Security Number, DoD Identification number, and place and dates of your last treatment information.

For A Healthcare Provider No Longer In Practice

If your healthcare provider retires or is no longer in practice, all medical records must still be maintained under the law. This pertains even if a healthcare provider has died or dissolves the practice without a sale.

Under the law, the medical records should be transferred to another healthcare provider that agrees to accept the responsibility. If a provider cannot be found, the records may be archived with a reputable commercial storage firm.

Similarly, if your healthcare provider has left the practice but the practice is still operating, your records must be maintained by the remaining members. If the practice was sold, the new practice will be responsible for the maintenance of the records and be liable if the records are lost or mishandled.

Tracking down your records can sometimes be a challenge, particularly if a healthcare provider’s office was closed with no forwarding details. In this instance, there are several things you can do:

  • Contact your state or local medical society. Many of these organizations require annual registration, they will most likely have the latest contact information.
  • Speak with your health insurance company. If the healthcare provider is still an approved provider, your insurer will have contact details.
  • Contact any hospital where your healthcare provider made rounds. Hospitals require healthcare providers to undergo a formal process to obtain hospital privileges. Human resource departments will usually have details on file.

Historically, medical records were kept and maintained by the primary care provider. In recent years, a trend has emerged that has seen patients taking responsibility for the storage and maintenance of their own medical records.

Unless you are in a healthcare system which provides you access to your electronic medical records , you will need to take steps to request copies for yourself.

According to the Health insurance Portability and Accounting Act of 1996, you have the right to obtain copies of most of your medical records, whether they are maintained electronically or on paper. These include healthcare provider’s notes, medical test results, lab reports, and billing information.

Amendments And Annotations To Service Records

If you wish to make an amendment to your personnel records that contain incorrect, out of date or misleading information you may do so by either of the following:

Privacy Act 1988

Australian Privacy Principle 13 correction of personal information provides that an APP entity must take reasonable steps to correct personal information it holds, to ensure it is accurate, up-to-date, complete, relevant and not misleading, having regard to the purposes for which it is held.

The requirement to take reasonable steps applies in two circumstances

  • Where an APP entity is satisfied, independently of any request, that personal information it holds is incorrect or
  • Where an individual requests an APP entity to correct their personal information.

You may apply, under the FOI Act, for amendment or annotation of a record of your personal information that you consider to be incomplete, incorrect, out of date or misleading.

How to Request Copies of Your Military Medical Records VA

This collection comprises The National Archives series, MH106, War Office: First World War Representative Medical Records of Servicemen. Only a sample of the medical records was retained. These records are a representative selection of the full collection of medical records created during the war. Due to data protection, Findmypast has only published records where the admission year is dated back 100 years. For this reason, more records will be released in the coming years. The records include admissions and discharge records from hospitals, field ambulances, and casualty clearing stations. You will also find records from Queen Alexandras Military Hospital before the First World War, dating from 1910. Below is a full list of the hospitals and medical facilities represented in the records.

The medical records were collected by the Medical Research Committee and then given over to the British Museum during the First World War, 1914 to 1918. The records were used for statistical research. In 1931, Thomas John Mitchell and G M Smith published History of the Great War, based on official documents. Medical services: Casualties and medical statistics of the Great War from the data gathered from these medical records.

Leaving The Armed Forces As A Commonwealth Gurkha Or Nepali Veteran

You will not get free healthcare from the NHS after your discharge date from the UK armed forces if you are:

  • a citizen of a member of the Commonwealth
  • a Gurkha citizen
  • a Nepali citizen

You will receive free healthcare up to your discharge date.

In order to receive free healthcare through the NHS after this date, you must gain indefinite leave by using the immigration rules and process.

  • you must apply within 2 years of your discharge date
  • the earliest you can apply is 18 weeks before your discharge date
  • it is recommended you apply as soon as possible after the 18 week point
  • you will not receive free NHS healthcare after your discharge date and before you have gained indefinite leave

The process may differ depending on how long you served and where you served, as well as if you have family members who are also looking to settle in the UK.

Collect Your Summary Medical Records And Documents

Military Medical Records Request Online

You can get 3 documents when leaving the armed forces that can help continue your healthcare without disadvantage. These are:

  • an NHS welcome letter that explains the process of transferring from military healthcare to an NHS GP surgery and civilian dentist, as well as information on what a GP can do to help you as a veteran
  • a form that includes important details for your GP surgery, including a summary of medical treatments, vaccinations and specialist care received
  • a paper copy of your summary medical records, which contains more detailed information about the medical treatment you have received while in the armed forces

You will usually receive the NHS welcome letter and the form during your final medical assessment at the end of your discharge period. If you do not receive them, ask a doctor at a medical centre to get them for you as soon as possible.

You will not usually be given a paper copy of your summary medical records unless you ask a doctor at your medical centre. It is better to ask for this earlier in your discharge period as it may take a while to arrive if they agree to provide a copy.

Who Can Obtain Veteran Records

  • Veterans. Recently-separated veterans can access their own records online from the eBenefits web site, including DD 214s, NGB-22s, AB8 Benefit Verification Letter, and more. More information is available in this eBenefits Fact Sheet. For older records, veterans can complete an online form at eVetRecs, but the request must then be printed out, signed. And mailed in.
  • Next of Kin, by following the same procedure at eVetRecs as the veteran.
  • The General Public, pursuant to the Freedom of Information Act , may request a limited subset of records of veterans who left the military within the past 62 years. Follow the procedures set forth here. The records available include:
  • Court Order. See NA Form 13027 for information on how to submit a court order for a veterans records. The National Personnel Records Center has a Court Orders page for more information.
  • Veterans Administration Records. The veteran herself can obtain records online at the VAs eBenefits page.

Service Records Versus Service Treatment Records

Service records are the paper trail and other documentation created during a service members period of military service, according to VA Publication M21-1, Part III, Subpart iii, Chapter 2. Service Treatment Records are a component of Service Records. There are three basic categories:

  • Service Treatment Records
  • Military personnel records
  • Clinical records

Each of these records can play an important part in determining military pay and benefits as well as determining any post-service benefits the soldier, sailor, airman, Marine, or Guardian may be entitled to or be considered for.

My Military Health Records

You should keep copies of your medical documentation, records, and health care history information for your own reference.

  • If you get most care at military hospitals or clinics, youll have a DoD electronic health record.
  • If you retired or separated after Jan. 1, 2014, paper copies of your Service Treatment Records were digitized following your retirement or separation from the Armed Forces. If your STRs dont contain information classified as sensitive, theyll be available via your Patient Portal, either TRICARE Online or MHS GENESIS.
  • To request a complete copy of your health record, youll need to submit a Request Pertaining to Military Records to the applicable organization as identified on the form. Requests can also be made in person to your last home military hospital or clinic.
  • Civilian providers may keep paper records or use a private electronic health record system.

    Complaints About Service Personnel

    Where allegations or complaints are made about the behaviour of individuals who can be identified as serving British Army personnel, the information is sent to the relevant chain of command. They will then make a decision as to whether an offence has been committed under the Armed Forces Act.

    The National Archives online program eVetRecs is the fastest method for requesting service information. Provide as much information as possible in the comments field. Should you prefer to submit your request using a SF180 then provide as much information as possible and send the form to:

    Veterans and Next-of-Kin may:

    • Fax a letter or Standard Form 180 to: 314-801-9195

    When sending a request via postal mail or fax, please use the Standard Form 180, Request Pertaining to Military Records. Although not mandatory, using the SF-180 is the recommended method to send a request for military service information. This form captures all the necessary information to locate a record. Provide as much information on the form as possible and send copies of any service documents that you may have.

    Follow the instructions for preparing the SF-180. Check the Records Location Table and submit your request to the appropriate address.

    Costs: Generally there is no charge for basic military personnel and health record information provided to veterans, next-of-kin and authorized representatives. If your request involves a service fee, you will be notified as soon as that determination is made.
