Military Service Not Count For Fers Vesting Period

The Court of Appeals for the Federal Circuit recently ruled that while military service can be used to buy additional FERS credit, it cannot be used to qualify for the 5 years of service in order for FERS to vest. Montelongo.Montelongo vs Office of Personnel Management, 939 F.3d 1351 .

A former soldier was a West Point cadet for 4 years, then ultimately retired after a 20-year Army career. He was later a presidential appointee to a federal civilian position, where he served just under 4 years. While there, he used his West Point time to buy four additional years of FERS.

The Office of Personnel Management concluded that for purposes of determining whether the FERS pension had vested, only his actual civilian service counted, and not his creditable military service. And that meant the employee had just under 4 years of service, thereby not qualifying for a FERS pension.

The Court of Appeals upheld the OPM finding that the service needed to meet two components to satisfy the 5-year vesting:

  • Civilian service, under § 8410.
  • In this case, while the employee had almost 8 years of creditable service, counting his West Point time he used to purchase additional credit. But only 4 years of that time was civilian service, as the rest of the credit was military service. The employee did not meet the 5-year civilian service requirement, so his FERS was not vested.

    How Does Rotc Work

    A person who participates in an ROTC program is both a college student and an ROTC cadet. As a student, they enroll in their college of choice that hosts an ROTC unit or has a crosstown agreement with one. That student typically selects a specific major, such as Civil Engineering, for example.

    Along with the chosen major, students will need to enroll as cadets in the ROTC program and take college classes taught by military instructors. These ROTC classes count for college credit, and in many ways are just like other courses. However, ROTC has unique requirements above and beyond any college program, including rigorous physical fitness program participation, leadership exercises, and a few weeks of military training during one summer.

    As a cadet, the student is in a pipeline aimed at producing military officers. As cadets finish their college and ROTC programs, they graduate and can then swear in as commissioned officers, activating their service commitment with their respective branch of service.

    The length of this commitment depends on the career field theyve been selected for, which is based on a mix of their personal choices, the jobs they qualified for academically and medically, and the current needs of the service.

    Those in the know at the U.S. Office of Personnel Management tell me that summer camp is counted for military service because its considered federal service. The challenge has been documentation of the period. The military services generally do not include ROTC service on a DD-214, so these individuals have to obtain other evidence. Proof of status as an ROTC cadet/midshipman and copies of pay vouchers from the Defense Finance and Accounting Service have generally been considered acceptable. I can just imagine how difficult it would be for you to get copies of pay vouchers back to 1966.

    So while its doable, its hard. Let me know if you have any additional questions.
