Which country military recruiting foreigners and how to join?

Currently, Deferred Action for Childhood Arrivals may face a new reality in the current administration and could be subject to deportation versus having the ability to work or attend advanced educational opportunities. An enlisted member enters the Army as a Private. After completing basic training, the enlisted recruits advances to Private First Class. The next notable advancement is to a Noncommissioned Officer.

The highest rank attainable in the Army is the five-star General of the Army. Often called a five-star general, the rank of General of the Army has historically been reserved for wartime use and is not currently active in the U.S. Army.

Military Spouses’ Right To Count Overseas Posting Time Toward Us Residency Requirements

If you are married to a U.S. citizen who is serving in the military and is stationed abroad, and you have a green card, and you accompanied your spouse on this overseas posting under official military orders, you can count your time living with your spouse overseas as if it were time spent in the United States. This will be important for fulfilling the various U.S. residency requirements for citizenship.

Also, you won’t need to return to the U.S. to apply for citizenship if you don’t want to. Instead, you can complete the naturalization process abroad.

Enlisting With A Green Card

A green card by itself does not let you join the U.S. Army. You must be living in the U.S., and be able to speak, read and write English fluently. You must also meet the same requirements all Army recruits face:

  • You are at least 17-years-old and no older than 35. That applies to regular Army, reserves and the National Guard.
  • You are in good health.
  • You have a high school diploma, though a GED may suffice.
  • You pass the Armed Services Vocational Aptitude Battery test.
  • If you want to become an officer, you must be a college graduate.

If you have a disqualifying condition such as health problems or a criminal record, you can ask the Army to waive it. There is no guarantee you will get a waiver, but there is no cost for making the request.

Advice About Possible Loss Of Us Nationality And Foreign Military Service

A U.S. national who is a resident or citizen of a foreign country may be subject to compulsory military service in that country. Although the United States recognizes the problems that may be caused by such foreign military service, there is nothing that we can do to prevent it since each sovereign country has the right to enact its own laws on military service and apply them as it sees fit to its citizens and residents.

Federal statutes long in force prohibit certain aspects of foreign military service originating within the United States. The current laws are set forth in Section 958-960 of Title 18 of the United States Code. In Wiborg v. U.S. , 163 U.S. 632 , the Supreme Court endorsed a lower court ruling that it was not a crime under U.S. law for an individual to go abroad for the purpose of enlisting in a foreign army however, when someone has been recruited or hired in the United States, a violation may have occurred. The prosecution of persons who have violated 18 U.S.C. 958-960 is the responsibility of the Department of Justice.

Green Cards For Surviving Family Members

Certain family members may apply for green cards as the “immediate relatives” of a U.S. citizen serviceperson, whether the relative was granted posthumous U.S. citizenship or was already a U.S. citizen at the time of his or her death.

Immediate relatives include the service person’s spouse , parents, and unmarried children under age 21. Or, if family members have already applied for green cards based on their relation to the deceased, they may go forward with the application as if the death had not happened.

Surviving family members, unlike most green card applicants, don’t need to prove that they’ll be financially supported or self-sufficient.

Although the immigration laws ordinarily require the parents of a U.S. citizen to wait until the child is 21 to apply for permanent residence with the child as the sponsor, this requirement doesn’t apply to the parent of a deceased service member who never reached age 21.

Note, however, that there’s a time limit on applying: You’ll need to file a petition using USCIS Form I-360 within two years of the service person’s death.

An Applicant For Naturalization Based On Military Service Must Meet The Following Requirements:

JOINING THE ARMY AS AN IMMIGRANT 2021

To apply under this eligibility category, you must be 18 years of age or older.

You may only use this eligibility category if you have an honorable service record or have been honorably discharged. You must have served for at least one year in the U.S. Army, Navy, Air Force, Marines or Coast Guard.

If you have separated from the U.S. Armed Forces, N-400, Application for Naturalization, must be filed within 6 months of the honorable discharge.

If you were discharged for other than honorable reasons, you are not excluded from naturalization. You likely would not meet the citizenship requirements for military. Instead, you would need to prepare N-400, Application for Naturalization, as a 5-year permanent resident or as a permanent resident married to a U.S. citizen for 3 years.

Most non-citizens that apply for U.S. citizenship through naturalization must be permanent residents before filing N-400, Application for Naturalization. However, members of the military must only be permanent residents by the day of the interview.

What’s more, the continuous residence and physical presence requirements are waived. Most applicants must be permanent residents for 5 years before submitting Form N-400. Military applicants can file right away.
