It depends. In order to receive benefits for injuries from the Department an applicant must qualify for active duty status as discussed above, meaning they qualify for benefits and services of the Department. Secondly, an applicant for benefits must show that there is a disability, and that the disability is present as a result of service in the military. If your disability developed as a result of service during a period of war, or any time of peace after 1946, the disability will be determined to have resulted from military service. Initially after a servicepersons death, a health plan and cost will not change, though options are available to adjust to a familys new needs.

Children remain covered until they age out of TRICARE eligibility 21-years-old without obtaining a full-time education, 23-years-old while obtaining a full-time education, or by getting married. In some cases, children who are adult survivors may qualify for their own TRICARE health plan.

Coverage for widowed spouses changes after three years, in which case their eligibility shifts to that of a retired family member . TRICARE benefits may also change or cease if the surviving spouse chooses to select other forms of coverage or remarry.

Family benefits for retired service members may continue on after a sponsors death, with the exact same plan they had before. They remain eligible for TRICARE and may have options to modify their plan to reflect life changes.

It is important to know the basic legal issues associated with employees on military duty. Following is a survey of the most important things to remember.

    The Basic Law

    The main law governing the employment rights of employees on military duty is the Uniformed Services Employment and Reemployment Rights Act of 1994 , found in Title 38 of the United States Code starting at Section 4301. The law does several things:

  • Employers must hold open the jobs of employees on military duty and may not otherwise discriminate against them because of their military service. Generally, a job must be held open for up to five years, but during times of a declared national emergency, the time for holding the job open must be extended until the emergency declaration is revoked. This is relevant because the national emergency declared on September 14, 2001 is still in effect.
  • The law gives that protection to every type and variety of employee.
  • Upon return from military duty, a veteran or employee who is still in the military is entitled to whatever position he or she would have attained with reasonable certainty if the military service had not occurred. In narrowly-defined situations, a veteran may be given a comparable position as long as the seniority, pay, and status remain the same.

    Failure To Update Deers

    Failing to keep information up-to-date in the Defense Enrollment Eligibility Reporting System can cause your heath care benefits to lapse. Unlike many of the other issues that may cause you to become ineligible for TRICARE, a failure to update DEERS can be easily fixed. Keeping information as accurate and up-to-date as possible can prevent ineligibility from happening.

    You are usually eligible to receive a military ID if you are currently serving in the military , or you are a military retiree. Qualified dependents are eligible for dependent ID cards as well.

    Finally, certain veterans are eligible for a military ID card if they are a Medal of Honor recipient, have a 100% disability rating, or in certain other limited circumstances.

    • You must be on Active Duty military status and be in the DEERS system.

    Paying For Military Service Credit

    Once we process your request, we will inform you of the cost to receive credit for your military service. If you decide to purchase the credit, you can choose from three payment options:

    • A single lump sum payment.
    • Payroll deductions.
    • A trustee-to-trustee transfer. We can accept transfers only from certain types of plans. Details will be provided in our cost letter.

    If you choose to make payments through payroll deductions, the length of time to purchase your previous service cannot exceed the total service credit you are purchasing. For example, if you are purchasing one year of credit, payment must be completed within one year. Also, you will be credited with your military service credit as you pay for it. For example, after six months of payroll deductions, you may be credited with 0.5 years of additional service.

    If you pay for military service credit, and it does not improve your pension benefit, we will refund your payments with interest when you retire. Also, if you die, and the military service credit you purchased does not provide a better death benefit, the cost plus interest will be refunded to your beneficiaries.

    Note: We do not accept payments from members who are off the payroll of a participating employer and are not vested.

    One Year Of Military Service At Any Time

    If you served honorably in the U.S. armed forces for at least one year at any time, you may be eligible to apply for naturalization. While some general naturalization requirements apply under INA 328, other requirements may not apply or are reduced. To establish eligibility under INA 328, you must:

    • Be 18 years old or older
    • Have served honorably at any time in the U.S. armed forces for a period or periods totaling at least 1 year

    Enlisting in the United States military is very different than applying for any other job. Not everyone will qualify, and there are strict rules which would never apply to civilian employment.
